Maybe this is why the levee board has posted
the best and largest part of the batture, known
as the Maynard Batture. The parish purchased
this area for $10,000,000 from Mr Maynard to be
used expressly for a "nature park. I would
rather see Colonial Club vaporize before the
developers ruin this.

to be concerned. I hope the group we had to get
rid of the tugboats and barges will be able to get
together again. Even though it's a new levee
board it is still political and my suspicion is
tugboats on the horizon. (They posted the signs) It
could possibly be any industrial enterprise.I did
not have to go far to find the signs One is right
over the levee in front of my house in Harahan.
Jefferson bought and paid for that land but the
levee board has jurisdiction. At least we control
the land use. I want to get back on it to enjoy and
take pictures. I don't think they can restrict
passage as we have been enjoying the batture for
years. The Parish has riparian rights but under
federal law it or the levee board can not stop us
from walking to the river. I ask you and all others
interested call Elton Lagasse at 736 6607. Let him
know you are interested and see if you can get
the new levee board number. Then post it here.

Batture land purchased jointly by the levee board
and the parish is the land in question. It is posted
from River Ridge up to one football field west of
CG&CC. Batture behind CC is not included and is
too narrow to be considered for any `use.
Harahan has relinquished it's responsibility to the
batture even though it is part of Harahan. The city
does not seem to care what goes on back there. I
sure would like to see what kind of property tax
has been paid on this property over the years.
It is a disservice to the citizens that the city does
nothing about the batture. It is our natural
greenspace.We pay a fee every waterbill to
support LaFreniere Park. It is not in our city but
guess which mayor helped implement this fee.
This fee should be transferred to a Batture Nature
Park and the Harahan portion be given over to the
city. This would be a park for all of 70123, to use
and support. There is no other practical use for
this land.

The area was privately owned until recently. The levee district paid half of the costs to procure the land which was put in the name of the levee district. Safety in that area is an issue. There are no walking trails. The property is overgrown and has ponds, sinkholes, dangling limbs from trees and broken glass. The levee district could be responsible if somebody gets hurt. The levee district cannot afford this liability. Until such time that money can be allocated again for recreation projects, the area will have to remain closed. Hopefully, in the future, we may be able to clean up this area and design some recreational use with the help of civic associations and perhaps Jefferson Parish. At the present time, the levee district is using all of its man power and resources to provide the best levee protection possible. (Exactly what is the levee district doing to provide the best levee protection possible?)

According to the EastBank Levee Board Director,
this is blighted and dangerous property and
because of liability issues they have to post it.
City Code requires more than this.
Posting or fencing does not fulfill the requirement
The danger and blight has to be corrected ASAP.
If the Board does not fulfill the requirement then
the city is obliged to correct the problem and then
place a lien on the property..
This property could be cleaned up and made
safer by volunteers, boyscouts, prison labor etc
POSTING OR FENCING DOES NOT PROTECT ANYONE FROM LIABILITY SUIT

Hi Lenny,
I am reprinting at the bottom of this e-mail part of a long e-mail I
wrote earlier this morning to another concerned reader. I don't have time
to write each of you detailed responses to the same general concern
because I am on deadline, but I'd like to clarify a few things.
The response below was to a reader who read my sunday story about no
recreation and Frank Donze's story the following day about restoration of
one of the marinas.
The bottom line of all Authority-East decisions, at this point, flows
from their directive to focus resources on activities and personnel
directly related to providing or improving flood control In that vein, the
authority believes that recreation isn't a flood defense.
As you'll read below, the Authority was created by a legislative act
and ratified by Louisiana voters, who agreed to amend the state's
constitution so that individual levee Boards would be abolished in favor of a
regional board that focused solely on flood control. If the Legislature
comes back with new law that says "flood assets" should include all
parks and green space, then the Authority East and Authority West will be
required to follow that law. (I don't know if that would require
another statewide vote and another constitutional amendment). But as things
stand now, the authority believes recreation isn't its mission.
Please see note below for more explanation:
The work being done to rebuild and improve the marina is being done NOT
by the Orleans Levee District, per se, but by specific OLD employees
who are now functioning on behalf of the Division of Administration. So
Louis Capo, who once directly represented the entire OLD, now represents
only the non-flood asset portion of the OLD and, in that position, is
working for the Division of Administration.
Meanwhile, under the new consolidated system, the management of flood
assets (led by levees and floodwalls) and the employees who service them
are being managed by the the Levee Authority, whose members believe
that they are responsible only for providing flood protection. And
certainly, ridding local districts of all non-flood activities was the heart
of levee reform that 80 percent of statewide voters authorized when
amending the state constitution.
Unfortunately, the law didn't define those assets.
Under the Authority's current resolution, Lakeshore Drive, the parks,
green space etc in Orleans Parish will be managed by the DOA, tho the
Authority's flood employees will continue mowing, picking up trash etc.
until the decisions are final and the transition complete.
Fast forward to East Jefferson Levee District, where I think the
Maynard batture is the largest "non-flood" asset. Rather than moving it to
the DOA, there is a legal agreement between the parish and EJLD that must
be examined by lawyers and decisions made on how to proceed. I am
working on a story to run, hopefully tomorrow, that looks at this issue, but
I expect that the parish will take title to it. Like so much that's
happening in response to the Katrina emergency, it's just too soon to know
what the resolution will be.
The levee authority will also continue to cut grass along the bike
paths because they're built on levees that are kept mowed for levee safety.
I also expect that local governments will keep the paths repaired
because federal money is available for that, and I'm trying to find someone
to confirm that.
I'm not sure that I've answered all your questions, or any of them to
your satisfaction, but I must rush out now to a meeting.

By the way, Doug, you are always free to criticize my reporting, but
please know that I did try to talk with DOA about this. No one returned

we do instead is to write follow-up articles that try to cover the
remaining bases.

what I understand about the flooding I can not fathom how creating
this new board corrects the Katrina flooding problem. When it comes to
Jefferson Parish, Katrina flooding, the Broussard administration is what
should be replaced, not the levee board which was not found remiss in
their duties to the people. Care to handle that one.

The politicians, Cindy Murray, Mosca, etc are not only talking
about annexation but also possible development of the batture.
You know I am not going for that. The batture that borders
Harahan is supposed to be subject to and located in incorporated
Harahan. Ms Fran Campbell admitted that that whole area is
blighted and dangerous. If it were a house or other property in
Harahan in the same condition would we let them get by with just
putting "no trespassing" signs up?

Am I wrong? Are there other avenues open to stop any batture
development?
Can we make them restore it back to pre-Katrina condition? It
was not posted before Katrina.
